We would like to begin our meeting by recognizing the First Nations, Metis and Inuit peoples of Canada as traditional stewards of the land.  The municipality is located within the boundary of Treaty 18 region of 1818 which is the traditional land of the Anishnaabek, Haudenosaunee and Wendat-Wyandot-Wyandotte peoples.

NOTE:  In accordance with the Municipal Conflict of Interest Act and the Town Procedural By-law 2021-76, Council Members must file a written statement of the interest and its general nature with the Clerk for inclusion on the Registry.

    THAT the Council minutes of April 25, 2022 be adopted as circulated, including revisions to be made.

Under the authority of the Municipal Act, 2001 and in accordance with Ontario’s Municipal Freedom of Information and Protection of Privacy Act (MFIPPA), The Corporation of the Town of The Blue Mountains wishes to inform the public that all information including opinions, presentations, reports and documentation provided for or at a Public Meeting, Public Consultation, or other Public Process are considered part of the public record. This information may be posted on the Town’s website and/or made available to the public upon request.

NOTE: In accordance with the Town Procedural By-law 2021-76 any person may provide comments during the Public Comment Period at a Council Meeting, regarding Town matters. Each person providing comments during a Public Comment Period shall be limited to not more than three minutes. The Clerk or a countdown clock shall alert the speaker when they have one minute remaining to address Council. Each person shall provide their name and address, and is required to address their comments to the Chair. Comments shall not refer to personal, litigation or potential litigation matters, or be in response to matters that have been the subject of a Public Meeting, it being noted that the verbal commenting period has ended. Written correspondence may still be received in response to matters that have been the subject of a Public Meeting.  If a person is unable to personally attend the meeting, or during any period where an emergency has been declared to exist in the municipality, they shall provide their Public Comments in writing to the Clerk in advance of the meeting for the Clerk to read on behalf of the author during the Public Comment Period.

    THAT Council receives the correspondence listed as Agenda items D.1.1 to D.1.21, less any items requested for separate review and discussion, and further does support the Staff recommendation made with regard to the Correspondence items, including any additional direction given to Staff through discussion, with an appropriate Staff action or response awaited for report back to Committee or Council, where indicated.

Re: Astec-BTI Request for Exemption to Noise By-law

    THAT Council receive Staff Report FAF.22.099, entitled “2022 Resident Satisfaction Survey Update”;

    AND THAT Council endorses and approves the survey questions in principle as presented and directs staff to conduct the survey with results presented back to Council in June 2022.

    THAT Council receive Staff Report FAF.22.101, entitled “Update to Social Media Strategy and Policy”;

    AND THAT Council selects option one or option two as listed below regarding public comments on the Town’s Facebook page:

    Option 1: Allow Comments

    AND THAT Council approves a three-month trial of allowing public comments to be posted on the Town’s Facebook page;

    AND THAT Council acknowledges that the Town’s Facebook page will only be monitored and that questions will only be responded to during regular business hours, being Monday to Friday from 8:30 a.m. to 4:30 p.m.;

    AND THAT Council approves that public comments will be disabled on all posts related to the 2022 Municipal Election;

    AND THAT Council directs staff to track all time related to managing and responding to public comments on the Town’s Facebook page and to provide a report back to Council at the end of the 3-month trial.

    OR

    Option 2: Disable Comments

    AND THAT Council approves a three-month trial of disabling public comments on the Town Facebook page;

    AND THAT Council directs staff to track all time related to managing the Facebook page and to provide a report back to Council at the end of the 3-month trial.

    THAT By-law No. 2022-36 being a By-law to erect stop signs at Beaver Street South and Alice Street West, Westbound and Eastbound on Beaver Street South be passed this 9th of May 2022.

    THAT No. 2022-37 being a By-law to amend By-law 2007-12, as amended to regulate or prohibit the parking or leaving of vehicles on privately-owned lands without the consent of the owner of the land be passed this 9th of May 2022.

    THAT By-law No. 2022-40, being a by-law to amend Zoning By-law No. 2018-65 to rezone those lands known as the Moreau Park from the Institution ‘I’ Zone to the Institution Exception 138 ‘I-138’ Zone and to rezone those lands known as the Beaver Valley Community Centre from the Open Space ‘OS’ Zone to the Open Space Exception 138 ‘OS-138’ Zone, be passed this 9th of May 2022.

    THAT By-law No. 2022-41, being a by-law to amend Zoning By-law No. 2018-65, to authorize the temporary use of municipal lands, to rezone those lands known as the Tomahawk Recreation Complex from the Special Agricultural ‘SA’ Zone to the Special Agricultural ‘SA-t1’ Zone and to rezone those lands known as Northwinds Beach from the Open Space ‘OS’ Zone to the Open Space ‘OS-t1” Zone and to rezone those lands known as Lion’s Park from the Village Commercial ‘C1’ Zone to the Village Commercial ‘C1-t1” Zone and to rezone those lands known as Little River Beach from the Harbour Commercial ‘C4’ Zone to the Harbour Commercial ‘C4-t1” Zone be passed this 9th of May 2022.

    THAT with regard to subsection 239 of the Municipal Act, 2001, this Council does now move into closed session in order to address matters pertaining to:

    1. litigation or potential litigation, including matters before administrative tribunals affecting the municipality or local board and the receiving of advice that is subject to solicitor/client privilege, including communications necessary for that purpose, and with regard to a legal proceeding;
    2. a proposed or pending acquisition or disposition of land by the municipality or local board and the receiving of advice that is subject to solicitor/client privilege, including communications necessary for that purpose, with regard to a proposed or pending acquisition of land;
    3. litigation or potential litigation, including matters before administrative tribunals affecting the municipality or local board and the receiving of advice that is subject to solicitor/client privilege, including communications necessary for that purpose, and with regard to an Ontario Land Tribunal matter.
