We would like to begin our meeting by recognizing the First Nations, Metis and Inuit peoples of Canada as traditional stewards of the land.  The municipality is located within the boundary of Treaty 18 region of 1818 which is the traditional land of the Anishnaabek, Haudenosaunee and Wendat-Wyandot-Wyandotte peoples.

    THAT the Council minutes of November 28, 2022 be adopted as circulated, including any revisions to be made.

    THAT with regard to subsection 239 of the Municipal Act, 2001, this Council does now move into closed session in order to address matters pertaining to:

    i)  the receiving of advice that is subject to solicitor-client privilege, including communications necessary for that purpose and with regard to an Ontario Land Tribunal matter.

Under the authority of the Municipal Act, 2001 and in accordance with Ontario’s Municipal Freedom of Information and Protection of Privacy Act (MFIPPA), The Corporation of the Town of The Blue Mountains wishes to inform the public that all information including opinions, presentations, reports and documentation provided for or at a Public Meeting, Public Consultation, or other Public Process are considered part of the public record. This information may be posted on the Town’s website and/or made available to the public upon request.

NOTE: In accordance with the Town Procedural By-law 2022-76 any person may provide comments during the Public Comment Period at a Council Meeting, regarding Town matters. Each person providing comments during a Public Comment Period shall be limited to not more than three minutes. The Clerk or a countdown clock shall alert the speaker when they have one minute remaining to address Council. Each person shall provide their name and address, and is required to address their comments to the Chair. Comments shall not refer to personal, litigation or potential litigation matters, or be in response to matters that have been the subject of a Public Meeting, it being noted that the verbal commenting period has ended. Written correspondence may still be received in response to matters that have been the subject of a Public Meeting.  If a person is unable to personally attend the meeting, or during any period where an emergency has been declared to exist in the municipality, they shall provide their Public Comments in writing to the Clerk in advance of the meeting for the Clerk to read on behalf of the author during the Public Comment Period.

    THAT Council receive Staff Report PDS.22.140, entitled “125 Peel Street – Campus of Care Municipal Affairs and Housing for Community Infrastructure and Housing Accelerator (CIHA) Order”;

    AND THAT Council of the Town of The Blue Mountains reaffirms its support for development of a Community Campus of Care on a portion of the property municipally known as 125 Peel St., Thornbury;

    AND THAT Council hereby supports a Community Infrastructure and Housing Accelerator (CIHA) Order to facilitate expedited zoning approvals required for the Campus of Care project;

    AND THAT Council hereby seeks an exemption for other necessary planning related approvals including Site Plan Approval, Plan of Subdivision and/or Plan of Condominium from the Provincial Policy Statement, the County of Grey Official Plan, and Town of The Blue Mountains Official Plan.

    AND THAT Council hereby directs staff to forward the Draft CIHA Order to the Ministry of Municipal Affairs and Housing to pursue an CIHA application that permits the development of a Community Campus of Care including the following components;

    1. Long Term Care facility for at least 160 beds with a maximum height of six (6) storeys
    2. Labour Force housing with a maximum height of six (6) storeys
    3. Retirement Home with a maximum of six (6) storeys
    4. A variety of housing forms and unit types that include demonstrated innovation in the delivery of attainable housing supply
    5. Enhanced naturalized stream corridor
    6. Setbacks and road widenings as may be required by the Ministry of Transportation, County of Grey and Town of The Blue Mountains
    7. Onsite and connected to community active transportation facilities
    8. Day care facilities

    THAT Council receives Staff Report FAF.22.172, entitled “Report on Identification, Removal and Prevention of Barriers from the 2022 Municipal and School Board Election, as per s. 12(3) of the Municipal Elections Act, 1996, for information.

    AND THAT Council acknowledge the Requests for Delegations to the following Ministries at the 2023 ROMA Conference taking place in Toronto from January 22 - 24, 2023:

    THAT By-law 2022-86, being a By-law to amend Zoning By-law 2018-65 to rezone portions of the Victoria Street North and Bay Street West Road Allowance to the Open Space "OS" Zone, be passed this 12th day of December, 2022. 

Councillor Hope provided the following Notice of Motion at the November 28, 2022 Council Meeting. In accordance with Procedural By-law 2022-76,the Notice of Motion requires a mover and seconder to be put before Council.

    WHEREAS virtual access to Council and Committee of the Whole meetings assists with greater access to Town meetings by all Town of The Blue Mountains ratepayers and;

    WHEREAS Staff and Council members have come to appreciate the merits of augmented communication opportunities with ongoing virtual access and;

    WHEREAS quorum is more readily established with this additional form of communication;

    WHEREAS an in-person presence is always preferred but cannot always be achieved;

    THEREFORE, the Town of the Blue Mountains does accept virtual communication by Council members and Staff as an alternate form of communication to an in-person presence at all Council/ Committee of the Whole and closed meetings and that a virtual presence of a Council member does count toward quorum;

    In regard to the consideration of allowing members of Council to actively participate virtually in Committee of the Whole Meetings and Meeting of Council, the following request be made to consider an efficient process to consider eliminating the number of meetings a Member of Council is permitted to attend virtually as required by the Town's Procedural By-law 2022-76 under the following sections:

    Section 13 b.. i) Electronic participation is not permitted in a Closed Session unless the municipality is in a declared state of emergency as referenced in Section 4.14;

    Section 13 b. iii) No more than three Council Members may be absent from or participating electronically in any Council Meeting, Committee of the Whole Meeting, or Council Meeting, Public Meeting;

    And Section 13 b. v) On a semi-annual basis, each Council Member may participate electronically in no more than four (4) Council, Committee of the Whole Meeting, or Council Meeting, Public Meeting, calculated from January to July, and from August to December each year;

    This Notice of Motion be considered a request that Council provide direction to staff to bring forward a recommendation through a Staff Report that identifies options to eliminate the limitations of Members of Council to participate electronically (virtually) in Council, Committee of the Whole Meeting, or Council Meeting, Public Meeting along with any other suggested modifications or amendments to the Town Procedural By Law that may be required to allow all Members of Council to participate electronically (virtually) without limitations.

Councillor Hope provided the following Notice of Motion at the November 28, 2022 Council Meeting. In accordance with Procedural By-law 2022-76, the Notice of Motion requires a mover and seconder to be put before Council.

    WHEREAS the 2022 election has occurred where there was much discussion about the timing and management of the Official Plan amendments passed in principle by the Town of The Blue Mountains Council on September 26, 2022;

    WHEREAS there is strong public feedback that more extensive consideration should be given to Phase 2 results before final Official Plan amendments are crafted;

    THEREFORE, Town of The Blue Mountains Council reconsiders its decision to support in principle the Official Plan Amendments that were accepted in report # PDS.22.114 titled “Information, Direction and Recommendation Report- Official Plan 5 Year Review Phase 1” passed at this date September 26, 2022.

Councillor Maxwell provided the following Notice of Motion at the November 28, 2022 Council Meeting. In accordance with Procedural By-law 2022-76, the Notice of Motion requires a mover and seconder to be put before Council.

    THAT Council of the Town of The Blue Mountains directs staff to plant a tree in memory of Councillor Jim Uram in recognition of his years of service as a Council Member on the Town of Thornbury Council, and the Town of The Blue Mountains Council, and for his general contribution to the community.

    THAT with regard to subsection 239 of the Municipal Act, 2001, this Council does now move into closed session in order to address matters pertaining to:

    1. a proposed or pending acquisition or disposition of land by the municipality or local board, the receiving of advice that is subject to solicitor client privilege, including communications necessary for that purpose, and with regard to a development; 
    2. personal matters about an identifiable individual, including municipal or local board employees and with regard to correspondence received;
    3. the receiving of advice that is subject to solicitor-client privilege, including communications necessary for that purpose and with regard to Bill 23, More Homes Built Faster Act, 2022; 
    4. litigation or potential litigation, including matters before administrative tribunals, affecting the municipality or local board and the receiving of advice that is subject to solicitor-client privilege, including communications necessary for that purpose and with regard to an Ontario Land Tribunal matter
