We would like to begin our meeting by recognizing the First Nations, Metis and Inuit peoples of Canada as traditional stewards of the land.  The municipality is located within the boundary of Treaty 18 region of 1818 which is the traditional land of the Anishnaabek, Haudenosaunee and Wendat-Wyandot-Wyandotte peoples.

NOTE:  In accordance with the Municipal Conflict of Interest Act and the Town Procedural By-law 2023-62, Council Members must file a written statement of the interest and its general nature with the Clerk for inclusion on the Registry.

    THAT the Special Meeting of Council minutes of May 10, 2024, the Council minutes of May 13, 2024, the Council, Public Meeting Minutes of May 14, 2024 and the Special Council Minutes of May 23, 2024 be adopted as circulated, including any revisions to be made. 

Under the authority of the Municipal Act, 2001 and in accordance with Ontario’s Municipal Freedom of Information and Protection of Privacy Act (MFIPPA), The Corporation of the Town of The Blue Mountains wishes to inform the public that all information including opinions, presentations, reports and documentation provided for or at a Public Meeting, Public Consultation, or other Public Process are considered part of the public record. This information may be posted on the Town’s website and/or made available to the public upon request.

NOTE: In accordance with the Town Procedural By-law 2023-62 any person may provide comments during the Public Comment Period at a Council Meeting, regarding Town matters. Each person providing comments during a Public Comment Period shall be limited to not more than three minutes. The Clerk or a countdown clock shall alert the speaker when they have one minute remaining to address Council. Each person shall provide their name and address, and is required to address their comments to the Chair. Comments shall not refer to personal, litigation or potential litigation matters, or be in response to matters that have been the subject of a Public Meeting, it being noted that the verbal commenting period has ended. Written correspondence may still be received in response to matters that have been the subject of a Public Meeting.  If a person is unable to personally attend the meeting, or during any period where an emergency has been declared to exist in the municipality, they shall provide their Public Comments in writing to the Clerk in advance of the meeting for the Clerk to read on behalf of the author during the Public Comment Period.

    THAT Council receives the correspondence listed as Agenda items D.1.1 to D.1.7, less any items requested for separate review and discussion, and further does support the Staff recommendation made with regard to the Correspondence items, including any additional direction given to Staff through discussion, with an appropriate Staff action or response awaited for report back to Committee or Council, where indicated.

Re: Referral of received correspondence from Terry Gates, Resident, regarding the CAMSafe Program and request of Council to consider how the Town can support the communication of the CAMSafe Program within the community.

    THAT Council receive Staff Report CSOPS.24.042, entitled “Kubota 6060 Tractor Emergency Repairs”;

    AND THAT Council approve the emergency repair costs of $15,000 for the Kubota 6060 Tractor.

    THAT Council receive Staff Report CSOPS.24.044, entitled “Youth Climate Action Fund Grant Acceptance Follow-up”;

    AND THAT the Mayor and Clerk are authorized to execute a Grant Agreement between the Youth Climate Action Fund as represented by Rockefeller Philanthropy Advisors and The Corporation of The Town of The Blue Mountains to receive $50,000 USD for administration and disbursement of funding for youth-led climate action projects;

    AND THAT the Mayor and Clerk are authorized to execute an additional Grant Agreement between the Youth Climate Action Fund and The Corporation of the Town of The Blue Mountains to receive the additional $100,000 USD of YCAF funding, in the event the $50,000 USD allocation is distributed to eligible projects by September 30, 2024 and if a new Grant Agreement is required;

    AND THAT, with respect to the requirement for establishment of “The Blue Mountains Youth Climate Action Fund Project Team”, as recommended in the within staff report, Council confirms the composition of The Blue Mountains Youth Climate Action Fund Project Team as follows:

    1. Mayor Matrosovs
    2. Member of Council (to be named)
    3. Member of Council (to be named)
    4. Sustainability Coordinator of the Town of The Blue Mountains
    5. Communications and Economic Development Coordinator of the Town of The Blue Mountains
    6. Public Member (to be appointed by Council following the call for applications)
    7. Public Member (to be appointed by Council following the call for applications);

    AND THAT staff are authorized to launch The Blue Mountains Youth Climate Action Fund application forms and guidance for applicants based on YCAF program templates along with essential promotions to facilitate the launch.

    THAT By-law No. 2024-44, being a By-law to amend Zoning By-law 2018-65 to rezone certain lands from the Residential Two Exception ‘R2-101’ Zone and General Commercial ‘C2’ Zone to the Residential Two Exception Holding ‘R2-101-h49’ Zone for those lands lying and being in the Town of Blue Mountains, legally described as Plan 529 Part Lot 151 RP 16R2128 Part 2 and Plan 529 Part Lot 150 and 151 RP 16R2128 Part 1, be hereby enacted as passed this 3rd day of June, 2024.

    THAT By-law No. 2024-46, being a By-law to amend Zoning By-law 2018-65 by rezoning the lands described municipally as 150 & 160 King Street from Commercial One (C1) Zone to the Commercial One - Holding 48 (C1-H48) Zone, be hereby enacted as passed this 3rd day of June, 2024.

Councillor McKinlay provided the following Notice of Motion at the
April 29, 2024 Committee of the Whole Meeting. The motion was included on the May 13, 2024 Council Agenda and deferred for consideration at the June 3, 2024 Council Meeting. In accordance with By-law 2023-62 the motion requires a mover and seconder to be put before Council.

    WHEREAS since 2020 the Town has subsidized flower watering and maintenance for the Thornbury Business Improvement Area (BIA) and the Clarksburg Village Association (CVA) through taxation; 

    AND WHEREAS due to the economic environment we are all currently experiencing, to keep additional levees down as well as taxation that Council directs staff to continue to provide annual flower watering and maintenance at no charge to these two associations listed above;

    AND THAT for the 2024 budget the services above be covered by the working capital reserve.

Councillor Ardiel provided the following Notice of Motion at the May 21, 2024 Committee of the Whole Meeting. In accordance with Procedural By-law 2023-62 the motion requires a mover and seconder to be put before Council.

    WHEREAS the Town of The Blue Mountains faces challenges related to limited access to transportation, and there exists a pressing need for a ride-sharing service to address transportation gaps within our community;

    AND WHEREAS Rideshare services are increasingly relied upon by seniors, students, visitors and tourists, and residents looking for safe, affordable, convenient, and reliable ways to travel; 

    AND WHEREAS the standardization and consistency of regulations across municipalities, particularly in Ontario, can improve the efficiency and effectiveness of the regulatory framework;

    AND WHEREAS transferring the responsibility of ride-share regulations and licensing to the provincial level would contribute to a more streamlined and uniform governance structure, while eliminating associated red tape and unnecessary administrative costs;

    THEREFORE BE it RESOLVED THAT the Town of The Blue Mountains Council hereby expresses its support for the migration of ride-share regulations and licensing from the municipal level to the provincial level; 

    BE IT FURTHER RESOLVED THAT the Town of The Blue Mountains Council formally requests the Government of Ontario to initiate the transfer of responsibilities in the interest of creating a more coherent and standardized regulatory framework for ride-sharing services across the province;

    BE IT FURTHER RESOLVED THAT that copies of this motion be distributed to the Honourable Doug Ford, Premier of Ontario; the Honourable Prabmeet Sarkaria, Minister of Transportation; the Honourable Paul Calandra, Minister of Municipal Affairs and Housing; the Honourable David Piccini, Member of Provincial Parliament for Northumberland-Peterborough South; the Association of Municipalities of Ontario (AMO); the Eastern Ontario Wardens Caucus, the County of Northumberland; and all six neighbouring Northumberland lower-tier municipalities, and all Ontario municipalities.
