We would like to begin our meeting by recognizing the First Nations, Metis and Inuit peoples of Canada as traditional stewards of the land.  The municipality is located within the boundary of Treaty 18 region of 1818 which is the traditional land of the Anishnaabek, Haudenosaunee and Wendat-Wyandot-Wyandotte peoples.

    THAT the Council, Public Minutes of October 1, 2024, the Council Minutes of November 12, 2024 and the Special Council Meeting Minutes of November 25, 2024 be adopted as circulated, including any revisions to be made. 

Under the authority of the Municipal Act, 2001 and in accordance with Ontario’s Municipal Freedom of Information and Protection of Privacy Act (MFIPPA), The Corporation of the Town of The Blue Mountains wishes to inform the public that all information including opinions, presentations, reports and documentation provided for or at a Public Meeting, Public Consultation, or other Public Process are considered part of the public record. This information may be posted on the Town’s website and/or made available to the public upon request.

NOTE: In accordance with the Town Procedural By-law 2023-62 any person may provide comments during the Public Comment Period at a Council Meeting, regarding Town matters. Each person providing comments during a Public Comment Period shall be limited to not more than three minutes. The Clerk or a countdown clock shall alert the speaker when they have one minute remaining to address Council. Each person shall provide their name and address, and is required to address their comments to the Chair. Comments shall not refer to personal, litigation or potential litigation matters, or be in response to matters that have been the subject of a Public Meeting, it being noted that the verbal commenting period has ended. Written correspondence may still be received in response to matters that have been the subject of a Public Meeting.  If a person is unable to personally attend the meeting, or during any period where an emergency has been declared to exist in the municipality, they shall provide their Public Comments in writing to the Clerk in advance of the meeting for the Clerk to read on behalf of the author during the Public Comment Period.

    THAT Council receive Staff Report PDS.24.148, entitled “Allocation Policy – Latest Draft”;

    AND THAT Council enact the revised by-law as of December 2, 2024 implementing a Water and Sewage Allocation Policy for the purpose of allocating water and wastewater services to new developments;

    AND THAT Council approve the transitionary provisions identified in PDS.24.081 for the purpose of implementing the Water and Sewage Allocation By-law in a fair and transparent manner;

    AND THAT Council direct staff to review the by-law 18 months following its enactment and recommend further revisions to the Water and Sewage Allocation Policy and associated Evaluation Framework.

    THAT Council receive Staff Report PDS.24.147, entitled “Recommendation Report – 24 Alfred Street Draft Plan of Subdivision and Zoning By-Law Amendment”;

    AND THAT Council enact a By-law to rezone the subject lands from Residential (R1-1) Zone to Residential (R1-1-h50) Zone, Residential (R1-1-150-h50) Zone, Residential (R1-1-151-h50) Zone, and Open Space (OS-h50)  Zone as outlined in Attachment 1 of Staff Report PDS.24.147;

    AND THAT Council support the Draft Plan of Subdivision and Draft Plan Conditions shown in Attachment 4 and Attachment 5 of Staff Report PDS.24.147 and refer the matter to Grey County Council for approval.

    THAT Council receive Staff Report FAF.24.152, entitled “Single Source for Solar Racking at Fire Hall 2”;

    AND THAT Council approve the hard specification and single source of solar racking at the new Fire Station #2.

    THAT Council of the Town of The Blue Mountains acknowledges receipt of the resignation of Mark McEwan, Board Member, from the Thornbury Business Improvement Area (BIA) Board and thanks Mr. McEwan for their contributions.

    THAT, Council of the Town of The Blue Mountains appoints   Council Member   as the Chair of the    department/division  of the Committee of the Whole meetings, for 2025 and to the end of the term of Council in 2026.

    THAT Council receive Staff Report FAF.24.155, entitled “Municipal Licensing By-law and AMPs By-law Revisions”;

    AND THAT Council provide a six (6) month extension for the collaboration between The Blue Mountain Ratepayers Short Term Accommodation Committee and The Blue Mountains Short Term Accommodation Industry Group to finalize a joint submission for Council consideration;

    AND THAT Council endorse, in principle, the proposed amendment to the Municipal Licensing By-law to change the “Licensing Appeals Committee” to “Licensing Appeals Officer” to allow for the recruitment of Licensing Appeals Officers and the development of a clear process and procedures for the hearing of Appeals under the Municipal Licensing By-law in advance of the by-law being enacted;

    AND THAT Council acknowledge and approve the further consideration of the implementation of a Type “E” License for Commercial Rental Units (CRUs) for future consideration and proposed implementation on January 1, 2026;

    THAT By-law No. 2024-77, being a By-law to manage the allocation of municipal water supply and sewage capacity, be hereby enacted as passed this 2nd day of December, 2024.

    THAT Council of the Town of The Blue Mountains direct the Accountability and Transparency Committee to review the Corporation's Procedural By-law 2023-62, through the lens of the new Accountability and Transparency of Town Actions to the Public Policy, POL.COR.07.01 and make recommendations to Council as required.

    2. litigation or potential litigation, including matters before administrative tribunals, affecting the municipality or local board, and with regard to litigation matters and legal fees;
    3. litigation or potential litigation, including matters before administrative tribunals, affecting the municipality or local board, and the receiving of advice that is subject to solicitor client privilege, including communications necessary for that purpose as it relates to two Ontario Land Tribunal appeals;
    4. litigation or potential litigation, including matters before administrative tribunals, affecting the municipality or local board, and the receiving of advice that is subject to solicitor client privilege, including communications necessary for that purpose as it relates to a development;
    5. a proposed or pending acquisition or disposition of land by the municipality or local board, and with regard to two land disposition matters;
