We would like to begin our meeting by recognizing the First Nations, Metis and Inuit peoples of Canada as traditional stewards of the land.  The municipality is located within the boundary of Treaty 18 region of 1818 which is the traditional land of the Anishnaabek, Haudenosaunee and Wendat-Wyandot-Wyandotte peoples.

    THAT the Agenda of August 18, 2022 be approved as circulated, including any items added to the Agenda.

NOTE:  In accordance with the Municipal Conflict of Interest Act and the Town Procedural By-law 2021-76, Council Members must file a written statement of the interest and its general nature with the Clerk for inclusion on the Registry.

    THAT the Council minutes of July 4, 2022, the Special Meeting of Council minutes of July 11, 2022 and the Council Public Meeting Minutes of July 11, 2022 be adopted as circulated, including any revisions to be made. 

NOTE: In accordance with the Town Procedural By-law 2021-76 any person may provide comments during the Public Comment Period at a Council Meeting, regarding Town matters. Each person providing comments during a Public Comment Period shall be limited to not more than three minutes. The Clerk or a countdown clock shall alert the speaker when they have one minute remaining to address Council. Each person shall provide their name and address, and is required to address their comments to the Chair. Comments shall not refer to personal, litigation or potential litigation matters, or be in response to matters that have been the subject of a Public Meeting, it being noted that the verbal commenting period has ended. Written correspondence may still be received in response to matters that have been the subject of a Public Meeting. If a person is unable to personally attend the meeting, or during any period where an emergency has been declared to exist in the municipality, they shall provide their Public Comments in writing to the Clerk in advance of the meeting for the Clerk to read on behalf of the author during the Public Comment Period.

    THAT Council receives the correspondence listed as Agenda items C.1.1 to C.15, less any items requested for separate review and discussion, and further does support the Staff recommendation made with regard to the Correspondence items, including any additional direction given to Staff through discussion, with an appropriate Staff action or response awaited for report back to Committee or Council, where indicated.

    THAT By-law No. 2022-64 being a By-law to amend By-Law 2018-67, as amended, being a By-law to appoint Municipal Law Enforcement Officers, be passed this 18th day of August, 2022.

Councillor Hope provided the following Notice of Motion at the August 9, 2022 Committee of the Whole Meeting. In accordance with the Procedural By-law, the Notice of Motion requires a mover and seconder to be put before Council.

    WHEREAS on June 28, 2022 at a Committee of the Whole meeting at the Town of The Blue Mountains, a unanimous vote of 6-0 was passed in support of item B.4.1 entitled,"171 King Street Disposition", regarding the land transfer to The Blue Mountains Attainable Housing Corporation;  

    WHEREAS, according to a transcript provided by The Blue Mountains Attainable Housing Corporation, on July 7, 2022 at a Board meeting of The Blue Mountains Attainable Housing Corporation, a publicly funded corporation of the Town of The Blue Mountains, Mayor Alar Soever, supported by Councillor Rob Sampson, did misinform the Board and the public of a result of a vote in the Committee of the Whole by misstating the above-mentioned vote as 6-1 while also inaccurately reporting that Councillor Hope voted against the motion;  

    WHEREAS, the Mayor further misrepresented the vote in the Committee of the Whole meeting by mischaracterizing Councillor Hope’s position in his remarks to The Blue Mountains Attainable Housing Corporation; 

    WHEREAS the Mayor apologized briefly to The Blue Mountains Attainable Housing Corporation Board and to Councillor Hope, on behalf of himself and Councillor Sampson, through an email to The Blue Mountains Attainable Housing Corporation, there was no correction made available to the members of the public who attended the Board meeting nor to members of the public with whom the Mayor and Councillor Sampson may have been interacting prior to the date of the apology on July 12th; 

    WHEREAS the Mayor, by way of his election to office, has the grave responsibility to share results of Committee of the Whole and Council vote results in an accurate and professional manner to preserve the trust placed in him by his community and, further, to not misinform the public who elected him;

    THEREFORE, Council does hereby confirm that the vote results of the June 28th Committee of the Whole were 6-0, with no votes against the motion regarding the motion B.4.1 entitled, "171 King Street Disposition" and that the vote results were inaccurately and inappropriately reported by Mayor Soever, supported by Councillor Sampson, during The Blue Mountains Attainable Housing Corporation Board meeting on July 7, 2022.

    WHEREAS The Blue Mountains Attainable Housing Corporation is a publicly funded corporation of the Town of the Blue Mountains, it has an obligation to report its activities in a transparent and accountable manner;  

    WHEREAS, to this date, The Blue Mountains Attainable Housing Corporation has refused to provide the recording of its July 7, 2022 Board meeting to a member of Council of the Town of The Blue Mountains about whom there was a discussion in the meeting;

    WHEREAS, there is no specific Blue Mountains Attainable Housing Corporation policy that has been shared with the same member of the Town of The Blue Mountains Council to support this action;

    WHEREAS The Blue Mountains Attainable Housing Corporation has not appointed an Integrity Commissioner to ensure compliance to the Town Code of Conduct by its members;  

    THEREFORE, Council requests the recording of The Blue Mountains Attainable Housing Corporation Board meeting held on July 7, 2022 to be provided to Council through the Clerk of the Town of The Blue Mountains.

    THAT By-law No. 2022-65, being a By-law to confirm proceedings of the Special Meeting of Council of The Corporation of the Town of The Blue Mountains on August 18, 2022 be hereby enacted as passed this 18th day of August, 2022.
