We would like to begin our meeting by recognizing the First Nations, Metis and Inuit peoples of Canada as traditional stewards of the land.  The municipality is located within the boundary of Treaty 18 region of 1818 which is the traditional land of the Anishnaabek, Haudenosaunee and Wendat-Wyandot-Wyandotte peoples.

    THAT the Agenda of January 30, 2023, be approved as circulated, including any items added to the Agenda.

NOTE: In accordance with the Municipal Conflict of Interest Act and the Town Procedural By-law 2022-76, Council Members must file a written statement of the interest and its general nature with the Clerk for inclusion on the Registry.

    THAT the Committee of the Whole minutes of January 9, 2023 be adopted as circulated, including any revisions to be made.

     

     

Finance, Administration, Legal Services and Fire Services Reports - To be chaired by Deputy Mayor Bordignon

NOTE: In accordance with the Town Procedural By-law 2022-76 Ten minutes allotted at the beginning and end of each section of the Committee of the Whole Meeting to receive public comments regarding matters included on the Agenda. Each person shall provide their name and address, and is required to address their comments to the Chair. Comments shall not refer to personal, litigation or potential litigation matters, or be in response to matters that have been the subject of a Public Meeting, it being noted that the verbal commenting period has ended. Written correspondence may still be received in response to matters  that have been the subject of a Public Meeting. If a person is unable to personally attend the meeting, or during any period where an emergency has been declared to exist in the municipality, they shall provide their Public Comments in writing to the Clerk in advance of the meeting for the Clerk to read on behalf of the author during the Public Comment Period.

    THAT Council receive Staff Report FAF.23.027, entitled “Amendment to By-law 2022-49, Being a By-law to regulate the parking, standing and stopping of motor vehicles on roads and properties under the jurisdiction of the Town of The Blue Mountains, and By-law 2018-67, being a By-law to appoint Municipal Law Enforcement Officers”;

    AND THAT Council enact an amendment to By-law No. 2022-49, Being a By-law to regulate the parking, standing and stopping of motor vehicles on roads and properties under the jurisdiction of the Town of The Blue Mountains. The amendment would add the parking lot located at 190 Gord Canning Drive to the list of parking lots where Blue Mountain Resort Security staff can enforce the Parking By-law.

    AND THAT Council enact an amendment to By-law No. 2018-67, as amended, being a By-law to appoint Municipal Law Enforcement Officers, that would add the parking lot at 190 Gord Canning Drive to the column that specifies which properties Blue Mountain Resort Security staff are permitted to enforce the Parking By-law. Additionally, the amendment to By-law 2018-67 would update the list of persons appointed as Municipal Law Enforcement Officers for the purposes of enforcing specific parking-related by-laws of the municipality on specific lands.

    THAT Council receive Staff Report FAF.23.023, entitled “Division Statistical Update Policy”;

    AND THAT Council be provided the draft Administrative Policy for “Division Statistical Updates” as presented in this report for information purposes.

    THAT Council receive Staff Report FAF.23.021, entitled “Potential Establishment of a Lobbyist Registry”;

    AND THAT Council endorse the Draft Lobbyist Registry By-law and Draft Lobbyist Code of Conduct as outlined in this report;

    AND THAT Council direct staff to bring forward a Final Lobbyist Registry By-law, and Final Lobbyist Code of Conduct as well as the proposed staff resource structure, policies and proposed Public Consultation Plan for Council consideration.

    THAT Council receive Staff Report FAF.23.013, entitled “Thornbury Business Improvement Area, Request for Assessment-Based Levy”;

    AND THAT Council directs the Town Clerk to review staff report FAF.23.013 with the Thornbury Business Improvement Area Board to receive input for Council consideration as to whether the 2022 to 2026 Thornbury BIA Board supports the request of the previous Thornbury BIA Board’s request to move to an “assessment-based” BIA levy, and if so, to provide input on the minimum or maximum levy to be charged, or both a minimum and a maximum levy, to be charged to each property;

    OR

    AND THAT Council directs that the minimum or maximum levy, or both a minimum and maximum levy to be charged to each property shall be set at a minimum of $ ___ and a maximum of $____;

    AND THAT Council directs the Town Clerk to provide notice to the Thornbury BIA membership of the proposed change in the levy structure in accordance with the requirements of the Municipal Act, and to report back to Council noting whether the conditions set out in the Municipal Act have been met to change the levy structure to an assessment-based levy, with minimums and maximums as directed by Council.
