We would like to begin our meeting by recognizing the First Nations, Metis and Inuit peoples of Canada as traditional stewards of the land.  The municipality is located within the boundary of Treaty 18 region of 1818 which is the traditional land of the Anishnaabek, Haudenosaunee and Wendat-Wyandot-Wyandotte peoples.

    THAT the Agenda of April 19, 2021 be approved as circulated, including any items added to the Agenda.

NOTE:  In accordance with the Municipal Conflict of Interest Act and the Town Procedural By-law 2019-56, Council Members must file a written statement of the interest and its general nature with the Clerk for inclusion on the Registry.

With the adoption of the Consent Agenda, all Recommendations found within previous Committee Reports or Minutes are then approved or received by Council, as noted. These Committee meetings are open to the public. The Consent Agenda content is available to the public when the Agenda is finalized but is not subject to discussion from the floor at this time, however, representations may be made at subsequent meetings on matters of interest.

    THAT the Council minutes of April 6, 2021 be adopted as circulated, including any revisions to be made. 

Under the authority of the Municipal Act, 2001 and in accordance with Ontario’s Municipal Freedom of Information and Protection of Privacy Act (MFIPPA), The Corporation of the Town of The Blue Mountains wishes to inform the public that all information including opinions, presentations, reports and documentation provided for or at a Public Meeting, Public Consultation, or other Public Process are considered part of the public record. This information may be posted on the Town’s website and/or made available to the public upon request.

NOTE: In accordance with the Town Procedural By-law 2019-56 fifteen minutes allotted at the Council Meeting to receive public comments regarding Town matters.  Comments may be provided regarding staff recommendations contained in staff reports that are a follow-up to a Public Meeting, it being noted that the commenting period has ended.


NOTE: The Town of The Blue Mountains continues to be in a declared state of emergency, and Council and Committee Meetings continue to be held virtually during this time.  Comments received from the public, that have not been included on the Agenda, will be read at the meeting by the Town Clerk.

    THAT, further to the March 25, 2021 Thornbury Business Improvement Area correspondence received by Council of the Town of The Blue Mountains at the April 6, 2021 Council Meeting, Council appoints Bruce Young to the Thornbury Business Improvement Area, Board of Management for the balance of the 2018 to 2022 Term of Council.

    THAT Council receive Staff Report PDS.21.050, entitled “Update Report – Application to Demolish Designated Heritage Dwelling (417014 10th Line)”;

    THAT Council authorize the additional extension of time under the Ontario Heritage Act for a decision on the Application to Demolish a Structure on a Designated Heritage Property, from 132 days to 369 days (December 13, 2021).

    THAT Council receive Staff Report FAF.21.060, entitled “Ontario Grant Funding to Help Municipal Fire Services Address the Impacts of COVID-19”;

    AND THAT Council provide direction to staff to move forward with purchasing feedback devices for firefighter training;

    AND THAT Council authorize the Mayor and Town Clerk to enter into the Fire Safety Grant Transfer Payment Agreement with the Office of the Fire Marshal.

    THAT Council receive Staff Report FAF.21.053, entitled “Amendment to By-law No. 2018-67, as amended, Being a By-law to Appoint Municipal Law Enforcement Officers (MLEOs)”;

    AND THAT Council enact an amendment to By-law No. 2018-67, as amended, being a By-law to appoint Municipal Law Enforcement Officers, that would update the list of persons appointed as Municipal Law Enforcement Officers for the purposes of enforcing specific parking related by-laws of the municipality on specific lands.

    THAT Council receive Staff Report CSOPS.21.027, entitled “Request for Budget Increase for Water Pressure Zone 4C Distribution Improvement Project”;

    AND THAT Council approve increasing the budget by 71.59% from $1,236,200 by $885,000 to a total budget of $2,121,200;

    AND THAT Council increase the funding from the Water Asset Replacement Reserve Fund by $885,000.

    THAT Council receive Staff Report CSOPS.21.026, “Public Information Centre for Drake’s Path Wastewater Servicing Extension”;

    AND THAT Council direct staff to proceed with holding a virtual Public Information Centre.

    THAT Council receive Staff Report CSOPS.21.028, entitled “Price’s Development Wastewater Servicing Extension and Storm Water Diversion Construction Tender Results and Public Information Centre”;

    AND THAT Council increase the project budget by $500,000 (24% over-budget) and direct staff to accept the tender and award the contract;

    AND THAT Council increase the required funding sources as per the Financial Impact section of this report;

    AND THAT Council direct staff to proceed with holding a virtual Public Information Centre (PIC).

    THAT Council of the Town of The Blue Mountains receives the Agricultural Advisory Committee Minutes dated February 18, 2021 as attached, for information purposes.

    THAT in accordance with the February 18, 2021 recommendation from the Agricultural Advisory Committee as noted:

    THAT with respect to a heritage apple variety nursery, the Agricultural Advisory Committee receives the request for information and recommends that Council direct staff to coordinate with Georgian Bay Fruit Growers with regards to project feasibility, CARRIED.

    AND THAT Council of the Town of The Blue Mountains directs staff to coordinate with Georgian Bay Fruit Growers regarding project feasibility for a Heritage Apple Variety Nursery.

    2. litigation or potential litigation, including matters before administrative tribunals affecting the municipality or local board, and with regard to an LPAT matter; 
    3. personal matters about an identifiable individual, including municipal or local board employees, and with regard to accounts receivable matters; and
    4. a proposed or pending acquisition or disposition of land by the municipality or local board, and with regard to the municipality's inventory of land
