We would like to begin our meeting by recognizing the First Nations, Metis and Inuit peoples of Canada as traditional stewards of the land.  The municipality is located within the boundary of Treaty 18 region of 1818 which is the traditional land of the Anishnaabek, Haudenosaunee and Wendat-Wyandot-Wyandotte peoples.

NOTE:  In accordance with the Municipal Conflict of Interest Act and the Town Procedural By-law 2022-76, Council Members must file a written statement of the interest and its general nature with the Clerk for inclusion on the Registry.

    THAT the Council minutes of February 13, 2023 and Council, Public minutes of February 14, 2023, be adopted as circulated, including any revisions to be made. 

Under the authority of the Municipal Act, 2001 and in accordance with Ontario’s Municipal Freedom of Information and Protection of Privacy Act (MFIPPA), The Corporation of the Town of The Blue Mountains wishes to inform the public that all information including opinions, presentations, reports and documentation provided for or at a Public Meeting, Public Consultation, or other Public Process are considered part of the public record. This information may be posted on the Town’s website and/or made available to the public upon request.

NOTE: In accordance with the Town Procedural By-law 2022-76 any person may provide comments during the Public Comment Period at a Council Meeting, regarding Town matters. Each person providing comments during a Public Comment Period shall be limited to not more than three minutes. The Clerk or a countdown clock shall alert the speaker when they have one minute remaining to address Council. Each person shall provide their name and address, and is required to address their comments to the Chair. Comments shall not refer to personal, litigation or potential litigation matters, or be in response to matters that have been the subject of a Public Meeting, it being noted that the verbal commenting period has ended. Written correspondence may still be received in response to matters that have been the subject of a Public Meeting.  If a person is unable to personally attend the meeting, or during any period where an emergency has been declared to exist in the municipality, they shall provide their Public Comments in writing to the Clerk in advance of the meeting for the Clerk to read on behalf of the author during the Public Comment Period.

    THAT Council receives the correspondence listed as Agenda items D.1.1 to D.1.10, less any items requested for separate review and discussion, and further does support the Staff recommendation made with regard to the Correspondence items, including any additional direction given to Staff through discussion, with an appropriate Staff action or response awaited for report back to Committee or Council, where indicated.

With the adoption of the Committee Reports included on the Consent Agenda, all Recommendations found within the Committee Report(s) are approved by Council, as recommended, less any items requested for separate review and discussion.

    THAT the recommendations found within the Committee Reports included on the March 6, 2023 Council Agenda are approved by Council, as recommended, less any items requested for separate review and discussion.

    THAT Council receive Staff Report FAF23.036, entitled “125 Peel Street Campus of Care Update”;

    AND THAT Council advise the community that on January 23, 2023, in a Closed Session Council meeting, staff provided a status update on the 125 Peel Street Campus of Care procurement process that included a recommendation to bring information from Closed Session to the public to ensure that transparency and openness regarding this project is re-established with the formal procurement process now being completed;

    AND THAT Council acknowledge that staff were directed to bring a Staff Report directly to the March 6, 2023, Council meeting;

    AND THAT Council advise the community that the formal procurement process that included the Request for Qualification (2022-24-PQ-ADM) concluded with one (1) submission being received and that lone submission being qualified by the Ministry of Long-Term Care and the Town;

    AND THAT Council advise the community that the lone qualified proponent permitted to move forward with the Request for Proposal (2022-74-P-ADM) process was peopleCare Communities as the lead proponent in collaboration with SkyDev;

    AND THAT Council advise the community that the formal procurement process that included the Request of Qualification (2022-24-PQ-ADM) and the Request for Proposal (2022-74-P-ADM) has been completed and cancelled without a successful proponent meeting the minimum mandatory technical scoring requirements;

    AND THAT Council acknowledge that staff were directed to negotiate with the lone qualified proponent, being peopleCare Communities and SkyDev, as permitted under Section 10 - Negotiation of the Town’s Purchasing of Goods and Services Policy (POL.COR.07.05), due to the time-sensitivity of the March 2023 Ministry deadline to secure a qualified long-term care provider for the provisional allocation of one hundred and sixty (160) long-term care beds;

    AND THAT Council advise the community that staff were directed to include the following key elements in the negotiations with peopleCare Communities and SkyDev:

    1. Acceptable height of five (5) stories for the labour force housing
    2. The Town be left with six (6) contiguous acres of developable land

    AND THAT Council, pending the outcome of further negotiations as permitted under Section 10 - Negotiation of the Town’s Purchasing of Goods and Services Policy (POL.COR.07.05), direct staff to schedule a Special Committee of the Whole meeting to allow representatives of peopleCare Communities and Skyline Skydev to present their proposed Campus of Care Project;

    AND THAT Council advise the community that approval of any of the following elements shall require a formal resolution of Council:

    1. Disposition of any portion of the 125 Peel Street property
    2. Approval of a Proposed Design and Preliminary Site Plan for a Campus of Care to be located on the 125 Peel Street property.

At the February 13, 2023 Council Meeting, Councillor Ardiel provided the following Notice of Motion.   As required by the Procedural By-law 2022-76, the Notice of Motion requires a mover and seconder before it is put on the floor for discussion.

    WHEREAS the Ministry of Food, Agriculture and Rural Affairs along with agricultural organizations have made it abundantly clear that in order meet the demands of our ever-changing world that our agricultural lands and rural areas need to be protected and preserved;


    THAT Council of Town of The Blue Mountains direct staff to consult with our local agriculture committee and agricultural  organizations about the history and current land use  of land that  is beneficial to achieve continuity and to explore the potential impacts of Bill 23 on certain classifications of  agricultural  lands fragmentation and potential risks to the local taxpayer  and  to also explore the impacts on all agricultural activities presently regulated by the  Department of agriculture and rural affairs and other governing bodies;


    AND the unintended  implications  that Bill 23 may directly and indirectly may  have an impact on and all of these considerations must be considered in the  official plan and increased  restrictive polices maybe required that are reflected within the official plan providing that these are in the overall best interest of the community, its taxpayers while meeting the needs to increase greater food security, protection of historical and natural assets and agriculture's contribution to climate change;

    THAT Council of Town of The  Blue Mountains recognize the importance of our specialty agricultural lands principally used for the production of apples and beyond this area are farming practices such as live stock producers, bee keepers, cash croppers, green house operators, dairy farmers, poultry producers, tree farmers, maple syrup producers, vine yards and those in the  forestry and commercial fishing industry and at the same time these products are either shipped, processed and packed or used for domestic consumption or add value to the recreation and leisure economy;


    AND THAT Council of Town of The Blue Mountains direct municipal staff to enshrine all aspects of agriculture and not only farming, but to include the right to farm to continue to ensure food security locally and regionally and at the same time recognizing agriculture’s contribution to mitigate climate change, in our official plan and policy statements moving forward.

    THAT with regard to subsection 239 of the Municipal Act, 2001, this Council does now move into closed session in order to address matters pertaining to:

    1. a proposed or pending acquisition or disposition of land by the municipality or local board, and with regard to the municipality's inventory of land (three matters);
    2. advice that is subject to solicitor-client privilege, including communications necessary for that purpose, and with regard to Town owned land;
    3. personal matters about an identifiable individual, including municipal or local board employees, and with regard to personnel matters
